How long does a property transfer take in South Africa?
Timelines depend on FICA compliance, rates clearances, whether the buyer needs bank finance, and deeds office queues. Many transfers take approximately 8 to 12 weeks from instruction to registration when documents and payments are provided promptly.
Who attends to the bond if the buyer needs a home loan?
The transferring attorney registers transfer of ownership. If the buyer needs a home loan, the bank appoints a bond attorney to register or cancel the mortgage bond — that is separate from the transfer mandate. Celeste Govender Inc attends to property transfers; bond registration and cancellation are not offered by this practice.
What documents do I need to sell my property?
Typically you will need your identity document, marriage certificate or antenuptial contract (if applicable), title deed, rates and levy accounts, and any estate agent sale agreement. If there is an existing home loan, your bond attorney (appointed by the bank) will attend to cancellation. Your conveyancer will provide a tailored checklist once the sale is agreed.
What is an antenuptial contract and when must it be signed?
An antenuptial contract (ANC) sets out whether you are married in or out of community of property, and whether accrual applies. It must be signed before the wedding. The ANC must be registered within 3 months from execution. Plan ahead for drafting, signature and registration.
Do you handle property transfers outside Durban?
Yes. While the practice is based in Durban, KwaZulu-Natal, transfers and related conveyancing can be attended to across South Africa, subject to the location of the property and deeds registry involved.
How will I receive updates on my transfer?
You will receive clear communication at key milestones — instruction, document collection, lodgement and registration. Enquiries are welcome by email, WhatsApp or via the enquiry form.
What does a notary public do?
A notary public authenticates and registers certain documents and notarial deeds required by law. If your matter needs notarial execution, it can be attended to as part of the firm’s services.
How are conveyancing fees determined?
Fees are guided by the Legal Practice Council conveyancing tariff and the complexity of the transaction (transfer, sectional title, etc.). A written estimate is provided when your matter is assessed.
